Normally the executor would handle this. If Mom is named on the policy, it is hers to cash. If Mom is the only survivng heir of the deceased, she would also have a claim on it. If there are other recognized heirs, they would split it.

Anyone can accuse. Proof is different. The house will be passed to the heirs or legatees of your mother. If there is no Will the house, or the proceeds from the sale of the house, will be distributed according to the statute on descent and distribution. Fi no living spouse the assets are divided evenly amongst the decedents children. In order to properly sell the house a probate must be opened and a representative appointed by the court. The representative will be charged with selling the house and distributing the net proceeds to the heirs.

Please don't. This is not a good idea (my opinion, based on my experience). Joint ownership of real property rarely works out for the children, and very often will result in economic loss and unnecessary grief. Besides, you may disqualify yourself from public benefits by deeding the property to your children, or you may disqualify one or more of the children, and you make your home a target for liens and identity theft your children are subject to. Make a will. Probate is not a lengthy or expensive process in Oregon; it is clean, well understood, and it results at the end of the day in a judgment which finally settles all your affairs.
