It has been 2 years since my GM died and the trustee (her attorney) has still not settled the trust. no debts, tax filed, is this legal?

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
You may want to request that accounting, if only as a prompt, and, if it is not timely provided, ask the court to replace the trustee. A Florida trust lawyer can advise you on whether Florida trust law or the language of this particular trust requires that final distributions be made by a certain date.

If the deed to the house is in your name, the house is yours. The only way that title can be changed is if you do it yourself.

What should I do if my trust that was left to me by my grandfather has been embezzled by two trustees and an attorney I hired?

You will need an attorney to help you with this. Recommend you check with whoever you talk to early in the conversation to see if he or she knows the attorney you are going after, to see if it is a conflict of interest. At some point, the information is going to come out, so you should deal with it up front.
