Could he, as a third party, delay the proceedings with a caveat or lawsuit if he believed he was entitled to compensation from the deceased?

Well, he could contest the will, if he asserted there was a later will, maybe one in which the wealthy woman leaves a gift to the charity of his choice. It's hard to imagine any other way a person not a devisee in the will could cause any delay. How about making your main character the person the wealthy woman named as her personal representative, so he is probating the will? Instantly, everybody hates him at that point.

Is it up to the personal representative of a will to decide whether a homestead property is an asset of the estate?

Answered by attorney Richard J Kaplan (Unclaimed Profile)
Estate Planning lawyer at Richard J. Kaplan, P.A.
The Personal Representative, with the assistance of their legal counsel, can make a determination if the property is homestead. If it is felt it is, then a court order declaring it homestead is necessary. If not sure, then you file a petition with the court on your best determination and let the court decide. If not, then no court order is needed. However, if the beneficiary tries to sell the property and a title agent later determines that it could be or is, then you will have to go back to court to get an order.

Do i need a revision of my will which was done in r.i.?

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
Maybe.  While most states respect a Will drafted in another state if it was properly drafted and executed under the laws of that state, Florida law may have benefits for you which were not available under the law of Rhode Island.  For example, you may be able to pass title to your home free of probate and free of Medicaid Estate Recovery in Florida.
