Unless the insurance policy was for the funeral and stated so in the contract, you have no rights to take his money and use it for funeral expenses. You will probably need a probate attorney and can discuss your options and your specific circumstances with the attorney

The child needs to obtain guardianship and conservatorship over her father if she wants to control his property.  I assume only the father's name is on the property? The girlfriend is at least a tenant and must be given 30 days notice to vacate.

A person must have "capacity" in order to execute a will or other testamentary instrument. The only exception is in the case of a conservator who is supervised by the court. A power of attorney does not give a party the power to draft new wills. You may want to find the assistance of an attorney who specializes in Estate litigation. Good luck!
