Yes, your sibling can make trouble for you over this. If you did not go to probate court you have essentially stolen money from the estate. For an estate of this size you could most likely file a small estate affidavit with the court. You would account for expenses for cleaning and settling the estate, pay your father's bills and split the remainder with your sibling.

Yes, but why? Are you thinking asset protection? Then you want limited liability companies, not revocable trusts. Revocable trusts in Oregon provide essentially no protection from the settler's creditors.

Does your mother's Will address her remains? Does it dispose of them to anyone? Who is named to serve as her Executrix/Executor. If it is her mother, you will have a difficult and possibly unwinnable battle. If not, then you may have a better chance of success. In either event, I suggest that you speak with a probate attorney about the issues, possible remedies and costs associated with bringing an action to recover the remains.
