You must open an estate.  In most states there is an abbreviated procedure for a small estate.  Please contact a probate lawyer who practices in the county in which your parents lived and died.

If you transfer your house to your husband (which is what he's talking about don't focus on the loan, focus on the ownership; and remember, the lender will only write a loan for the person or people who own the house) nothing happens when you die, because you don't own the house any more. Your husband could write a will leaving the house to your sons; he could also change his will or sell the house after you die. I cannot imagine that there are savings so substantial from refinancing that it is worth taking this risk.

Unless there is a anti-nuptial agreement in place, a deceased spouse can no longer disinherit a surviving spouse in Florida anymore. So the $1 possibly won't work. She would be entitled to at least 30% of his worldwide assets, with set offs of assets that may have been jointly owned between them or she received as a distribution from him. This includes assets that were jointly owned with someone else or payable to someone else (like in life insurance).
