What can I do if brother has the power of attorney but left me out of everything?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Estate Planning lawyer at Peters Law, PLLC
It is probably too late now, since your mother died in 2003, unless the estate is still open. When did you turn 18? If within the last 2 years you may have a claim for fraud. You need to talk with an attorney about the details.

As long as children have attained the age of 24 and are not disabled at the time of the decedent's death, they are not entitled to inherit from him, and the property can be disposed of in a will.

Can an hoa evict a new owner?

Answered by attorney Richard J Kaplan (Unclaimed Profile)
Estate Planning lawyer at Richard J. Kaplan, P.A.
If within the documents of the Association (much like a Condominium Association) it requires such approval, then yes they can have the right to prevent a new owner. It is not as common with HOA's, but it does happen.
