If you transfer your house to your husband (which is what he's talking about don't focus on the loan, focus on the ownership; and remember, the lender will only write a loan for the person or people who own the house) nothing happens when you die, because you don't own the house any more. Your husband could write a will leaving the house to your sons; he could also change his will or sell the house after you die. I cannot imagine that there are savings so substantial from refinancing that it is worth taking this risk.

No one is responsible for anyone else debts when someone dies. However any assets in which the person who died own is subject to claims by any creditors to the estate. The fact that someone is charge of an asset (ie an executor of an estate) does not make them the owner of the assets of the estate and thus not subject to the executor's creditors.

First you need to find out if the estate was probated. If it was and you were named in the will you need to motion the court to force the administrator to act. You can find out if it was probated by going to the county court and doing a search under your father's name.
