Do I have to get a new EIN number for trust?

Answered by attorney Brian Haggerty (Unclaimed Profile)
Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
You don't need to get another new EIN; but yes, all the trust's accounts should be under that EIN. Remember that you need to account annually; do yourself a favor, and simplify down to fewer bank and brokerage accounts.

How do I prevent medicare from taking my mom's life savings?

default-avatar
Answered by attorney Andrew R Byers (Unclaimed Profile)
Estate Planning lawyer at Byers & Goulding, P.L.C.
Yes, but this is an area where you need an elder law attorney who is experienced with Medicaid planning. Your mother may be able to save at least half of her savings. Medicare will only pay for up to 100 days of rehab. in the nursing home. The program you need to be concerned about for long-term care is Medicaid.

Can my husband as her POA do these types of transactions since the POA document does not limit his powers?

default-avatar
Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
What your husband can and cannot do should be spelled out in the POA form. If it is not, you would need to look to state law for powers. Michigan has a new POA statute that provides some guidance, but the default is the POA form itself. Your husband should document EVERYTHING he does.
