If my father planned for separation, does this factor into her claim?

Answered by attorney David L. Leon
Estate Planning lawyer at David L. Leon, P.C.
No. Texas law does not recognize a separation. The spouse would be entitled to 50% of the community estate. There may be an issue as to what is considered community property, and what is separate property, however.

How to transfer inherited home deed to another person?

Answered by attorney David L. Leon
Estate Planning lawyer at David L. Leon, P.C.
I would have to get more information, such as: 1. Who is the titled owner? 2. Did the titled owner die? If so, was there a will? 3. What was the date of death? 4. Did the deceased owe any other money aside from the house? 5. Did the deceased own any other assets?
