How can we remove a co-trustee from our mothers will?

Answered by attorney David Goldman

Your trust is irrevocable, you need to evaluate it under the current trust laws and the date it was formed. It may be as simple as sending them notice of removal with two independent witnesses but it may require more, you should have the documents evaluated by a Florida Estate Planning Lawyer to determine what must be done in your circumstances.

What are our options if there is a dispute over a will?

Answered by attorney David Goldman
Estate Planning lawyer at Law Office of David M. Goldman PLLC
Probably not, but she can leave her 1/2 interest to the other 3 children. This should be done before her death to avoid the ownership to pass to the other child. If she has other assets, she can also make up the difference using a will or trust to account for the difference in asset value. You might consider looking at an enhanced life estate deed.

Is filing with probate mandatory?

Answered by attorney Sabina Tomshinsky
Estate Planning lawyer at Home Town Law, P.A.
The custodian must deposit the will within 10 days after receiving information that the testator is dead with the Clerk of the Court where the testator died (in this case the Clerk of Palm Beach County). If the custodian fails to do so, an interested person may file a petition to compel the custodian to produce and deposit the will. A probate attorney should be able to determine if probate is necessary after an in-depth evaluation of all the pertinent factors. There are a lot of different variables to consider when determining whether probate is necessary, and if so, which proceeding must be commenced. Good luck!
