Yes you need an attorney. Anytime your freedom is in jeopardy, as well as a criminal record, it is huge. They may not charge you, but if they do, hire a local expert to represent you.

Am I to plea for OWI first or second offense?

Answered by attorney Loren M. Dickstein
DUI/DWI lawyer at Lewis Dickstein P.L.L.C.
Do you have an attorney? It is concerning that you have to ask such an important question over the internet. You deserve to have a lawyer that takes the time to discuss all of these important issues with you. If you are charged with a second and have a plea offer of a first, that is an okay deal. Why not an impaired? Is your driver's license through Michigan or another state? I highly suggest you talk to your attorney about these issues and if he or she is unable to answer your questions in a way that makes sense to you, it may be time to hire another lawyer.

It is very rare to have the drinking offense decreased to a non-drinking charge, get an attorney now, this is very serious.
