How good of a chance do I have of getting this DUI charge reduced?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
It should be simple to reduce to DWAI, but doing better may be tougher. We may be able to win your drivers license hearing, so make sure to request one. In response to your DUI Questions: I am a criminal defense attorney that focuses on DUI cases. If you would like to discuss your case, please contact me. Some important information- If you have been served with a Notice of Revocation, then you have 7 days to request a hearing. Please do that immediately by going to your local DMV office, tell them you got a DUI and you want to request a hearing. They will give you a form. DO NOT REQUEST THE OFFICER. We can do that later if we choose to, but most often it means you will lose. The receipt DMV gives you allows you to drive until the day of the hearing. Representation begins when client pays attorney an agreed upon retainer and returns a signed fee agreement.

What are my chances if the cop didn’t take my blood or administer a breathalyzer test within two hours?

Michael J Nichols
Answered by attorney Michael J Nichols (Unclaimed Profile)
DUI/DWI lawyer at Nichols Law Firm PLLC
This would be a rising blood alcohol defense. However, one must proceed with caution of you took a breathalyzer at the roadside.

What happens if i was arrested for DUI and after six days a report was not filed?

Answered by attorney George Martin Derieg (Unclaimed Profile)
DUI/DWI lawyer at The Derieg Law Firm
This just means the police officer either did not finish the report, or his/her supervising officer has not signed off on it. Unless the DA says in court that te do not plan to seek charges on this case, you may have to wait up to a year to see if you are being charged. If they have not filed charges against you in a year, then you shouldn't have to worry about being charged.
