Can they use a reckless driving and they said I have something else in Vegas 30 years ago?

Thomas S. Hudson
Answered by attorney Thomas S. Hudson (Unclaimed Profile)
DUI/DWI lawyer at Hudson Law Office
Short answer: Yes, they can use anything against you. Not all prior offenses MUST be used against you, but all of the can. Whether it is the policy to use such old events is largely dependent on the poicy of the particular county's State Attorney's Office. You should hire a lawyer who is familiar with your particular county.

So i have been told police now dont have to read your miranda rights go figure.....i was arrested and questioned all over tape not ever ever read

Answered by attorney Erin L. T. Ranney
DUI/DWI lawyer at Erin L.T. Ranney, PLLC
The police only have to read an accused their rights under Miranda when the person is 1.) under arrest and in custody and 2.) being questioned about a crime (that one or another one).  This response is general in nature and is not legal advice. No attorney client relationship is formed by it. Further, the response does not represent the opinions or views of LexisNexis or its affiliated companies.

Can I be charged with a DUI if the keys were outside of the car and the arresting officer smelled?

Answered by attorney Robert E McCall (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Robert E. McCall
Florida law doesn't care about the keys. Our statute says if a person is in "actual physical control" of the vehicle they can be arrested for DUI. Sleeping in the back seat of a car, keys with someone else a person can be arrested and found guilty. Unfair? Yes, talk to the democrats in the legislature they passed the law and block any changes.
