In Florida one could spend the rest of the probationary time in jail. In addition there could be a three year minimum mandatory sentence imposed on the new offense, and the state probably has 4 years to bring the charge.

Immediately report the crime to the police and press charges. They have rape and assault counseling, as do many organizations. Police will have a list. Use them. Enlist family and friends for moral support. Good luck.

Once a police report has been made, the allegations and charges are sent to the District Attorney to determine whether to file charges with the court. The decision to file charges, reduce charges, prosecute a case or dismiss a case is solely at the discretion of the District Attorney or Prosecuting Attorney. If the "victim" wishes to have the charges dropped or dismissed, he/she should talk with the D.A. However, the final decision will be up to the D.A. If your boyfriend has a criminal case pending from these charges, I strongly suggest that he contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding his case. He/she would then be in a better position to analyze your case and advise you of your options.
