Is it possible to get early probation termination after I received a DUI in November 2014 under super drunk law?

Yes, it would be possible to obtain early release from probation, but you are correct that a drunk driving can never be expunged under Michigan law.

Can you still challenge a breathalyzer after sentence has been given and served?

I'm not sure what you are asking, the earlier offense is over and done, the defenses are no longer available. His/her new attorney may choose to raise issues in the earlier case as part of a sentencing memorandum on the new case but it is likely to go no where. The real moral of the story? Hire a competent DUI defense attorney and fight the case.

Have been pulled over for a DUI, put the handcuffs and told me to sit, didn’t take to jail does it still consider an arrest?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
No, it should not appear on your record as a DUI. To appear as a DUI, you would have gone to court and either had to plead guilty, or be convicted in trial. It might appear as an arrest on your record. That depends entirely on what the officer entered in his paperwork and into his computer. You can request your criminal record from the state and if it appears you can request that it be expunged so that it can't hurt you.
