Your story sounds insanely stupid. While driving your vehicle, you 1st friend drove vehicle into bar and then left. You remained in the vehicle, probably drunk, and a 2nd friend decided to climb into a damaged vehicle to talk to you. Then the police arrived. You need to be arrested for being a stupid drunk. Please write back after you try this story in court with the judge.

If that is what is holding matters up, I would request a dismissal. Although, it would be at dismissal without prejudice meaning they could re-file it when the blood results come back in. The Michigan State Police has been taking an inordinate amount of time with lab results taking up to a year in many cases. It is a problem that will hopefully get resolved soon.

You do not have to admit to alcohol, but the real question is what will you say when the officer smells alcohol and you deny that you consumed any alcohol? What will you tell the jury at your jury trial for DUI, about why you LIED to the police officer when everyone smelled alcohol on your breath.
