If you are found guilty, a felony conviction, jail or prison time and a fine. There will be a revocation of your driver's privileges. That has nothing to do with any civil action which will most likely be brought for damages by the deceased relatives or heirs. Is it fair that the officer didn't record the interaction between the two of you? Probably not, the conversation as you relate it may be helpful, the fact that the Officer had recording equipment available and chose not to use it may be raised during either your trial or other confrontational hearing.

The fact that you have a medical marijuana card is not a license to smoke and drive. I suspect that a blood test was taken. If so, what do the results state? If you have any marijuana in your system, you could very well be screwed. It would also be interesting to see the police officer's reports and the observed driving. My advice. get an attorney.
