DUI/DWI lawyer at Musilli Brennan Associates, PLLC
Yes, they are much stricter. I would most strongly suggested that you engage an attorney immediately. You are facing loss of license and very significant fines not to mention what it will do to your insurance rates.

Can a police officer follow you with their headlights off?

Answered by attorney J. Allen Fiorletta
DUI/DWI lawyer at The Fiorletta Law Group, PLLC
Yes. However, there may be other defenses available to you based upon the circumstances of the initial stop, or defects in either the roadside testing or the PBT/Breathalyzer results.

How likely would it be to have a 3rd DUI reduced to a misdemeanor?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
Usually most prosecutors will not lower a felony DUI to a misdemeanor unless there are evidentiary or legal problems with the case or unless you are eligible for sobriety court. DUIs are very political for prosecutors and they are not going to continually cut you a break. That is why you need to invest in an experienced OWI attorney more than ever because the stakes are so high. A good DUI lawyer will thoroughly evaluate every area of your case for any issues that could be used to get the case dismissed or as leverage to get a better plea deal.
