Is it legal if I didn't get my Miranda rights when getting arrested and just read it to me at the station?

Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
The more important question is, what statements did you make after you should have been "Mirandized?" This is a question you should ask a DUI defense specialist when you call looking for representation, it seems like you want to beat the case, you will need a lawyer to help you.

Can I ever get my DUI expunged?

Answered by attorney Cindy Mannon (Unclaimed Profile)
DUI/DWI lawyer at Cindy Mannon, Attorney at Law
I am afraid a DUI will never go off your record. After about 10 years, you may not find it on Michigan Master Driving Record; however, it is always on the Secretary of State's and police lien system. The reason is because if you get 3 DUI's in a lifetime, under Heidi's Law, you can be a felon. It used to be 3 within 10 years. So in order to keep track of someone's DUI/OWI/OUID/Impaired driving convictions, they are always there. You can never get them expunged. Sorry, but people ask me this all the time, and a drunk driving offense sticks around forever.

If I was charged with a DUI and I asked for a test and the officers would not give me one, what can I do?

If you mean you asked for an additional test of your own choosing after submitting to the implied consent testing procedure, then the police may have unlawfully interfered with your right to obtain an independent test. Contact an experienced DUI attorney for a more careful case review.
