What do you mean, "if no one was in the car". Are you telling me that the person was driving while under the influence and then jumped out of the cart before the police came? If that is your argument, it's not a very good one. However, for a more definitive answer I would need to review the facts of your case.

A DWI arrest is not on your DMV record unless you are convicted or you get some kind of suspension for the offense. It does not mean that you were not charged you were. And, the DMV will not be the authority that will get the result of your blood test. It will be the prosecutor's office. The DMV employee does not know what she is talking about.

If you are underage and operating a vehicle with alcohol in it, you can be charged with minor-in-possession (MIP). If drugs are found in the vehicle, the Prosecutor can charge you with a drug crime.
