If I was charged with my second DUI charge, will I be thrown in jail?

A. Marie Felsen
Answered by attorney A. Marie Felsen (Unclaimed Profile)
DUI/DWI lawyer at Law Office of A. Marie Felsen, Esq.
Call me! In LA it's usually between 4-10 days but you are often out in a weekend & in OC you have to be quick to start qualifying for Ankle Bracelet to avoid jail. In San Bernardino & Riverside county all my 2nd & 3rd DUI clients have been offered alternative sentencing - like work release or ankle bracelet.

If you were caught while under the influence of marijuana can they drug test you at court?

Answered by attorney Philip Daniel Hache
DUI/DWI lawyer at Law Offices of Phil Hache
No, Courts do not do drug testing while a case is pending. If there was a term of continued release to do drug testing, then your friends would know about it. Other than that, they are no going to go to a court hearing and get forced to take a drug test unexpectedly. They should speak to an attorney in their area about their cases though.

If they are within the 10-year statutory period, it could be 120 days up to 1 year in jail; you might want to hire counsel to explore other options for you too.If they are within the 10-year statutory period, it could be 120 days up to 1 year in jail; you might want to hire counsel to explore other options for you too.
