If the officer didn't see me drive can he arrest me for DUI?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
You have a good case, but you need an experienced DUI attorney. The DMV has found that sitting in the drivers seat with keys in the ignition is "driving" under their rules - but you did not do this voluntarily and even were entrapped to do it by the first cop this needs to be proven and you likely cannot do this alone. The criminal case can also be won, but you need help. If you have been served with a Notice of Revocation, then you have 7 days to request a hearing. Please do that immediately by going to your local DMV office, tell them you got a DUI and you want to request a hearing. They will give you a form. DO NOT REQUEST THE OFFICER. We can do that later if we choose to, but most often it means you will lose. The receipt DMV gives you allows you to drive until the day of the hearing. Representation begins when client pays attorney an agreed upon retainer and returns a signed fee agreement.

If I got a DUI in May 2005, should I report this on job applications even after I completed probation?

Answered by attorney Andrea Rogers (Unclaimed Profile)
DUI/DWI lawyer at The Rogers Law Firm
If you were actually convicted of the DUI, it will appear on a criminal background report. If you were given a suspended imposition of sentence (SIS) with probation, then if you successfully completed probation without any violations, there should be no conviction on your record. Applications for professional licensing often ask, "Have you ever pleaded guilty or been convicted of a criminal offense?" If so, the answer would be yes, you have pleaded guilty but you were not convicted. (With an SIS, you have to plead guilty to the original crime before the judge will suspend the sentence and put you on probation.)

Is there anything I can do to overturn a guilty DUI verdict?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
It is possible to appeal. To win an appeal, you need to show that there was something constitutionally wrong with your trial. Take your case to a lawyer who handles appeals and you may be able to get a new trial.
