Will BAC 0.13 might be able to have wet reckless?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
DUI/DWI lawyer at Nelson & Lawless
You should be asking your own attorney. Might be able to have wet reckless. Quite unlikely. Generally requires less than .08 plus positive and sympathetic extenuating circumstances. Besides, the penalties and consequences are the same for it or DUI. It is something offered to get a plea from people who think they are getting a break.

I had a DUI 11 years ago, will it affect me getting a job?

A. Marie Felsen
Answered by attorney A. Marie Felsen (Unclaimed Profile)
DUI/DWI lawyer at Law Office of A. Marie Felsen, Esq.
A DUI stays on your DMV DRIVING RECORD for 10 years. On your criminal record it will be listed as a misdemeanor (unless it was a 4th DUI or you were convicted of a felony DUI with injury) forever unless you have it removed by having it "expunged." If you paid your fine on time and you completed your probation (usually 36 months) then you most likely will be able to expunge your misdemeanor DUI conviction with no problem. This turns it into a "dismissal" - and you could say you've never been convicted after you expunge it - furthermore, only jobs with the state- like fireman, or police officer -would even see it - private business would no longer see it. In other words, if you are worried about this DUI being used against you, then get it removed - I charge about $400 to do that. Now do I think it will affect you getting a job? Who really knows? I would think that if someone really likes you and if you have the skills to do a job it shouldn't be something that would keep you down because it's a misdemeanor. Most employers will pick the person who can do the best job and who can bring the most profit to the business regardless of the Misdemeanor from 11 years ago. However, most job applications ask if you have been convicted of a felony- and it is pretty clear that a felony may affect you from getting a job. Clearly many businesses draw the line at felony not misdemeanor.

How can you get a driving while influenced conviction for a car that cannot run?

default-avatar
Answered by attorney Mark K. Rosenfeld (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Mark Rosenfeld
You should not wait to get representation. If you think a Judge is going to dismiss the case because a kid says so you got another thing coming. As judge will not even listen to your son except to hear guilty or not guilty. In California you need driving or movement of the car to be a DUI. It does not matter if the car can run only that it moved. If it did not move... you have a good defense but it must be handled properly... both at the DMV and in court. Get a good lawyer ASAP. Mark Dedicated to the defense of good people accused of driving under the influence.
