How long does a DA have to amend a misdemeanor violation (23152a/23152b/12500/a) where no formal charges were brought?

The D.A. has one year from the date of the incident to bring misdemeanor charges. I suggest that your contact an experienced criminal defense attorney to help you with this matter. If more than one year lapsed before the D.A. filed charges, it may be possible to have the case dismissed.

Unpaid first-offense DUI fine, possible to have the DUI expunged?

Answered by attorney John Jimenez
DUI/DWI lawyer at Jimenez Law Offices
I doubt if everything is clear with the court. The fine should still be outstanding. The granting of a Penal Code section 1203.2 petition to dismiss a DUI conviction is discretionary with the court and would most likely NOT be granted in your case. In fact, I doubt that a court would even terminate your probation early. DUI convictions are generally NOT handled like other cases when it comes to granting someone some relief from the conviction. Most courts will not give anyone a break with a DUI.

If I have a first offense DUI, is there any way my fines can be reduced?

Answered by attorney Maltaise E Cini (Unclaimed Profile)
DUI/DWI lawyer at Maltaise Cini
The fines cannot be reduced on a DUI. However, you can have the fines converted to community service if you cannot afford to pay the fines. If you do not own a vehicle you need to go to DMV and complete paperwork stating that you do not own a vehicle so that you will be exempted for installing the IID.
