Can a DUI expungement eliminate my probation period and how difficult is it to expunge a DUI record?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)

You need to petition the court for an early termination of probation, a lawyer in your area can discuss the process, likelihood of getting a motion granted and the costs associated with the motion. My experience has been that if you are not on probation the armed services will allow you to enlist, expungement can be requested when probation has ended (either it has been ordered concluded early or the time runs) but it isn't necessary for a recruiter to allow you to enlist.

Will I have to serve jail time for my first DUI?

Brian Nelson Steele
Answered by attorney Brian Nelson Steele (Unclaimed Profile)
DUI/DWI lawyer at Steele Law Offices
Though in most cases you will avoid initial jail time on a first DWI, it is important you take the matter seriously. Some courts are sentencing some jail on a first time DWI. More importantly, all courts will stay up to 90 days in jail and place you on probation. That means, if you violate a term of probation you will go to jail. It is important to manage the terms of the probation at sentencing to avoid any unreasonable terms.
