The matter is still under investigation. If it can be determined who was driving, then the appropriate charges will be filed, including, I presume, vehicular assault.

To answer your question, yes an Officer can arrest. They have the power, even in cases where they don't have the right. This is one of the reasons you should never resist, even when the Police are wrong. Having said that, you should hire both a criminal defense attorney and a civil rights attorney to address this situation.

Yes. The out of state DUI class will count for the court. If you ever come back to California you will have to do the California DUI class to get your license back.
