Is it possible to release a 2nd DUI into a first since I did not have any trouble with the law in years?

Probably NOT,l but he is trying to get paid, and you probably are sending signals that you are only going to be retaining an attorney that can produce. So, he is lying to you. Worse comes to worse, you may spend more than 30 days in jail. If your work does not allow you to miss time for jail, or distrust you because of your lack of judgement in getting arrested twice for DUI (which indicates a drinking problem), then you might lose your job.

If have no prior DUIs within the past 7 years and your Blood Alcohol Concentration was equal to, or greater than .15, you will be required to serve 2 days.
