If never convicted with a clean record can you refuse the breathalyzer more than once?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
You can request a blood test in addition to an intoxilyzer or urine test, but you are not entitled to refuse a test required by law enforcement even once. You may be thinking of the fact that penalties and suspensions are harsher if you refuse or have an OWI conviction beyond the first one. You would be well advised to find a skilled lawyer.

I have a 17 year old DUI on my record is there any way to get off my record?

Not easily, but at 17 yrs old with no additional charges it is probably irrelevant for most purposes.

When do I know if I was charged with a DUI?

If you were charged with a DUI, you should have received a citation or notice to appear in court. The date showing on the citation is the date when you should appear in court. At that time you will know exactly what you are being charged with.
