Not necessarily. Generally when someone is charged with a DWI, the cop does not add the infraction charge. That being said, if there is no reason or violation of a vehicle code, then it ay be possible to have your DUI charges dismissed by way of a suppression hearing (or trial).

There is no way to get the warrant lifted without jail. The warrant (violation of probation warrant) can only be lifted by your incarceration.
