How can we keep property to myself and children?

default-avatar
Answered by attorney Eric K Johnson (Unclaimed Profile)
Divorce lawyer at Utah Family Law LC
Because the house was your separate property and your husband did nothing to contribute to its maintenance during the course of the marriage, you could make a compelling argument that he is entitled to no share if in your house. Premarital property loses its separate identity and becomes a part of the marital estate if ?(1) the other spouse has by his or her efforts or expense contributed to the enhancement, maintenance, or protection of that property, thereby acquiring an equitable interest in it, or (2) the property has been consumed or its identity lost through commingling or exchanges or where the acquiring spouse has made a gift of an interest therein to the other spouse.

How much is child support?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
Child support is based on a number of factors, including but not limited to: * Each parent's income; * Whether either parent pays or receives spousal maintenance; * Whether either child has other natural or adopted children in his/her custody; * Whether either parent is court-ordered to pay child support to a not-common child; * The age of the child; * The cost of the child's medical/dental/vision insurance; * The cost of the child care; * The cost of any education expenses (e.g. private school tuition); * The cost of any extraordinary expenses (e.g. if a child has special needs); * The parenting time schedule practiced by the parents. I recommend you contact an attorney who can perform some calculations for you to give you an idea of how the guidelines apply to your specific situation.

How do I make my husband to show his income and assets if I'm a housewife and have no income and no way to pay an attorney?

default-avatar
Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
You should see an attorney, file an action, and under the circumstances asked that he contribute or pay your cost of an attorney. Generally, all income which was received during the period of the marriage is considered to be marital property. There are processes called discovery which allow you to find out what, if anything he has. He will have to answer the questions under oath and penalty of perjury.
