You must do a divorce by publication.  Of course, you would have had to been a Georgia resident for six months prior to, and this kind of divorce does not address property or child issues.

My husband leaves and takes my child and now wants back into the house to collect his stuff what can I do?

You should make arrangements to let your husband get his things. If you need protection call the police or sheriff for a civil standby. It is important to be reasonable. The more the two of you fight about things, the more you will fight about things. Best to try to move forward.

What should I do if I can't get my spouse served and he refuses to sign the waiver?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)

How and when does he see the children? If you know he is coming to see the kids have someone 18 or older with them. When he arrives, they had him the papers. He is served. If you still can't get him served you will need to get order to be allowed to serve by publication.
