I signed papers not knowing i would have to pay child support & he gets custody. what should i do

Michael Todd Hampton

This depends on a few factors. Generally speaking, a person is presumed to understand and read what they signed, so it may be difficult if the papers you signed clearly state you are to pay child support. On the other hand, if there is fraud, or some sort of duress or genuine misunderstanding, you may be able to undo the agreement. A lot depends on the timing as well, so don't wait too long if you want to contest it. You should definitely contact a lawyer as soon as possible.

If I live in Georgia and my wife lives in DC, how do I go by divorcing her since we've been separated for 2 years?

If you have been a resident of the state of Georgia for at least six months, then the state of Georgia has jurisdiction over your status as either married or not married. Whether the state of Georgia has any jurisdiction over the person of your spouse is another question. If she will voluntarily signed papers and submit herself to the jurisdiction of the court, you can have an uncontested divorce in Georgia. You can also have an uncontested divorce and the state of her residence as well as a contested case in the state of her residence. You may or may not be able to have a contested divorce in Georgia depending on whether there is jurisdiction over her person.

Will a divorce let my husband contest the divorce

Thomas Lee Maddox
Answered by attorney Thomas Lee Maddox (Unclaimed Profile)
Divorce lawyer at Tommy Lee Maddox, PC
The only way that a divorce can be contested is that you are not living in a bona fide state of separation [still romantically involved].  Beyond that, he cannot prevent you from obtaining the divorce.
