If my husband and I divorced, will he still pay for part of the school loan debts incurred during the marriage?

No student loans are not a debt that will be divided since you are the only one who will benefit from the education once you are divorced. All debt is not divided 50/50 so you would do well to get a lawyer to help you understand the law.

Can you get into trouble if you want to date someone else while separated and filing for divorce?

Often not much, but you just might wind up before a judge who has a strong disposition against that kind of behavior and shows it by awarding your spouse a disproportionate share of community property, or concludes you're a less suitable parent for custody and visitation purposes. Only if there's no property and no children at issue can you know with reasonable certainty that dating before the divorce won't turn around and bite you. I know this is not the answer you wanted, but why not get the divorce over with first? The case only has to be on file for 60 days before you can finalize it.

Student Loan Debt in Divorce

Jeffrey D. Stearman
Answered by attorney Jeffrey D. Stearman (Unclaimed Profile)
Divorce lawyer at Law Office of Jeffrey D. Stearman
Generally, if the student loan was incurred during the marriage, it is generally considered a community debt. If the loan was obtained before the marriage, it is considered a separate property debt of the party taking the loan. If community funds (generally earnings of either party after marriage) were used to pay on the loan, the other party may be entitled to reimbursement for 1/2 of the amount paid towards repayment with community funds. This response is general in nature and should not be considered legal advice.
