You only get 1/2 of the pension which he earned during your marriage. So, if you stay married a total of 10 years and he worked for 30 years to get the pension, I'm using that because it makes the numbers easy, you would be entitled to half of 1/3rd of his pension benefits, about 1/6th of the benefits. You are not entitled to any benefits for the time he was earning benefits, but not married to you.

A divorce is never automatic.  It's very important that you file and have him served before he leaves as service is mandatory and the divorce or annulment cannot go forward without service. If he would agree that he married you for papers, you may have grounds for annulment which would void the marriage as if it never took place.

When a payor spouse does not pay the court ordered support payment there are steps that can be taken to collect the money, and/or encourage compliance. An earnings assignment Order can be obtained and the money taken out of the paycheck. If self employed assets may be garnished. Sometimes the government will help collect the money. Lastly a contempt action can be filed and have the delinquent payor face community service or jail time, and economic sanctions. It is important to stop delinquency right away because all the actions take time to process, and the recipient will be out the income until the result can be achieved.
