Can I bring my new wife without consequence, and then, after I arrive back home, continue to attempt to locate my estranged mate?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. The big question is are you divorced from your first wife. If you were married to your "estranged mate" and never divorced, your present marriage to your 2nd wife is invalid. By bringing your new wife here and petitioning for her, you could be committing immigration fraud and your wife would be deported. I strongly suggest that you contact an experienced family law attorney to handle your marital problem and an experienced immigration attorney for your immigration problem for a face-to-face consultation and give them all of the facts surrounding your situation.

Can my husband take the vehicle from me with going to court?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
How was the vehicle titled? In your name alone, in both your names or in just his name? What other property is involved? In Idaho, you each are entitled to 50% of the community property and 50% of the community debt. You need to work through all of the property and debt to figure out if one owes the other. So, it kind of depends as to whether the car was community property or separate property and how it is titled will give some evidence of that.

Divorce Decree is not being followed by ex

John Michael Frick
Answered by attorney John Michael Frick (Unclaimed Profile)
Divorce lawyer at Reid Dennis Frick, PC
Yes, there can be repercussions for not abiding by a court order.  The divorce court that issued the order might hold your ex-spouse in contempt of court, might enter other orders to enforce its property division, or might need to clarify the decree so that its order is clear and unambiguous enough to enforce by contempt.  The attorney who assisted you in your divorce proceedings should be able to discuss your options for enforcement including the anticipated cost of further proceedings.
