Be careful here. Although there is an agreement that might protect you, your spouse can say that he actually put money into the value of the home by his payments and improvements, for which you would have to pay him back. Some courts might view your permitting such actions as agreeing to a change in the agreement.

Where should I file for my divorce?

In order to file for Dissolution (divorce), one of you must be a resident of that state of California for at least 6 months and of the county where you intend to file for at least 3 months. If you want to file in Orange County so that your case will be heard local to your residence, rather than in San Bernardino, even though you have only been in California for 5 months, you may file for Legal Separation now. Then, after you have reached your 6 month residency, you can amend your Petition from Separation to Dissolution and proceed with the divorce. See Family Code Section 2320-2322.

Your question is not clear with respect to the facts. Check the court records to determine whether orders have been entered. If so, you have 30 days from the date of the final order to request a new trial. If you are speaking of a time frame related to filing an answer, then you should file a written answer.
