How can I get divorced if I got married, did my husband's permanent residence card and now he has other family in Mexico?

Answered by attorney Gerard A. Fierro (Unclaimed Profile)
Divorce lawyer at Gerard A. Fierro & Associates
You can file a divorce action in California if you have lived in the State for 6 months and the same county for 3 months. Depending where the husband lives could present challenges to serve him the Petition. It would be much easier if you serve him in California or he signs a document acknowledging service of the divorce Petition.

You would need to present papers to the court on an emergency basis to at least be allowed to see your 3 year old and get the judge to order visitation.

Is he entitled to spousal support from me and for how long?

Spousal support is dependent on many factors. At the beginning of the dissolution of marriage support is set by a computer function. At the trial at the end of the case there are many statutory considerations for the court to consider. Spousal support can be estimated by a knowledgeable attorney supplied with all the relevant facts of the case.
