No one is required to hire an attorney, you may represent yourself in court. However, you are still held to the same laws and rules. If you have not done your paperwork correctly, it will be rejected. You also may not know everything to include for your own benefit (meaning your papers would meet minimum legal standards, but might not be in your best interest). If you go forward on your own, do your research and get all the help you can from the self help center at your family court (they cannot give you legal advice, but can help you with the process and paperwork). In California, the MINIMUM time required before a divorce can be granted is six months and one day after the Respondent is properly served with a copy of the dissolution paperwork (which you previously filed at the court). This assumes everything runs smoothly, the two you are able to settle the case, and there are no set backs in the process.

Without more information about how long it has been since the final divorce decree or what state the divorce was in it isn't possible to fully advise you. In general, an omitted asset can still be dealt with in a subsequent proceeding, but it is not clear why your house was not "brought up". However, if you are divorced and the house is titled solely in your name, your ex- is a "legal stranger" and is, therefore, trespassing if you have told her to move. If the police won't help you, your only option may be to go back to court to get a specific court order directing her to leave. The general nature of a divorce should include that by implication but apparently your ex- doesn't agree or accept the obvious.

Alimony is determined by both a need for support but also the other spouse's ability to pay. Before a spouse can be eligible for alimony, however, the marriage must have lasted at least 7 years. Depending upon how long you were married will determine whether your spouse can even try and obtain alimony. If that threshold is met, then the next question is does she need the support and can you provide it? If she has her own job and you don't make all that much money, then it is questionable whether she can have a court order any alimony. Florida will provide shared parental responsibility and there will be overnight time sharing for both parents, unless there is a reason that it would not be in the child's best interest to do so. This is difficult to do. You haven't mentioned anything about your wife being a bad or neglectful mother and so simply because she spends a lot of money and doesn't contribute won't somehow result in her having diminished parental rights. There will be child support calculated by the child support guidelines, taking into account both parents' incomes, the needs of the child, and the time-sharing schedule. You should really hire an attorney right away and file for divorce.
