If they are deeded off the property due to divorce, can a mortgage company modify a loan without both borrowers consent?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Divorce lawyer at R. Jason de Groot, P.A.
How can a mortgage company be deeded off the property? Your question is very confusing. I think that you must be asking if both borrowers do not consent, can the mortgage company modify the loan. They probably will not, but there are many mortgage companies.

How do I get divorce and retain my green card?

Answered by attorney David Nabow Soloway
Divorce lawyer at Kennedy, Nalepa & Soloway, P.C.
I am sorry to learn that you have been the victim of domestic violence and torture, and to learn of the problems with your marriage that you described. There is no way that a U.S. citizen spouse can terminate his foreign national's Permanent Resident status (her "Green Card"), since that is a benefit issued by the U.S. government and not by the U.S. citizen spouse. Although not completely clear from your question, it sounds like you traveled outside the U.S. two months ago and are staying in your parents' house. Be aware that a single absence from the U.S. of 180 days or more may trigger a presumption that you have abandoned your residence in the U.S. (and your Permanent Resident status), and a single absence of a year or more may trigger a non-rebuttable determination of abandonment. It would be wise for you to consult with a domestic relations (divorce) attorney about your rights and responsibilities in the event of a divorce, and if that attorney does not have sufficient expertise relating to the immigration issues, that attorney should communicate with or associate an immigration attorney.

How can I get a divorce from the one I married in another country?

File for a contested divorce in Florida. If you do not have an address for the spouse you may serve them, by publication. A complicated procedure and it is best to hire an attorney.
