How do I begin the divorce process and where should I start?

Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)
Divorce lawyer at Joanna Mitchell & Associates, P.A.
You need to consult with and retain an attorney to assist you. The attorney can draft the papers that you need to sign in order to start the divorce process, and get them filed for you and served on her. You need to file a legal action immediately to prevent her from moving. If you have already been established as the biological father, then you should be able to stop her relatively easily. If you have not already been established as the biological father, then you need to do that first. You need to consult with an attorney immediately. In the meantime, detailed answers (under Florida Law) to many frequently asked questions regarding divorce, custody, visitation, child support, alimony, paternity and other.

If my ex forecloses on the house, how do I protect my credit?

default-avatar
Answered by attorney Troy T Gorman (Unclaimed Profile)
Divorce lawyer at Gorman Law Group, PC
If your name was not on the original loan, or if it was removed as part of the quit claim deed agreement, then it should not impact your credit. However, the lender would have had to agree to remove you from the loan obligation, which is not often done.

Do I have a right over a house that I helped on paying but only had my husband’s name on it?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
Absolutely. If he owned the house before you married him, you are entitled to reimbursement payments equal to a specific formula known as the Moore-Marsden formula. If the house was acquired during marriage with money earned during marriage you are entitled to one-half the net equity in the house. I strongly suggest you make an appointment with an attorney to get more information and assistance on this very important issue.
