Can I divorce my husband for controlling all the money and vehicles?

Anthony O. Van Johnson
Answered by attorney Anthony O. Van Johnson (Unclaimed Profile)
Divorce lawyer at Anthony Overton Van Johnson Associates, P.C.
Georgia is very liberal on grounds for a divorce. If nothing else, Georgia permits parties to divorce on the ground that the marriage is "irretrievably broken", meaning there is no possibility for reconciliation. If the divorce is uncontested, the divorce may be final in as little as thirty-one (31) days. Accordingly, if you believe that there is no possibility for reconciliation in your marriage, then, at a minimum, you may proceed with a divorce action on this ground. Any other grounds for divorce that you include (if any) would have to be proven.

Can I ask court to move her out of my house until the divorce is final?

default-avatar
Answered by attorney Anita Alice Webster (Unclaimed Profile)
Divorce lawyer at Law Offices of Webster & Associates
What happens with the house depends in large measure how the title is held and how much equity and value was added to the house post marriage if the house was solely in your name. You should speak to an attorney about the specifics of your case.

Can I sue for legal costs for hiding employment income?

default-avatar
Answered by attorney Pamela R. Lawson (Unclaimed Profile)
Divorce lawyer at Law Offices of Pamela R. Lawson
Your ex wife had a duty to notify you if her employment constituted a significant raise of income to her, assuming you have joint custody of your child. If you do not have joint physical custody of your child, it does not matter that she makes more income - the calculation of a non custodial parent is statutory. If you do have joint physical custody, before making a motion for modification of child support, your counsel, under our local rules must attempt to resolve the matter with your ex prior to filing a motion. The court has the jurisdiction and power to award "reasonable" attorney's fees for having to bring the motion; it is up to the judge to make the decision whether or not to award fees and how much to award.
