You must submit a Judgement of Dissolution with the Notice of Entry of Judgment form. The Notice of Entry of Judgment form is only the notification that a judgment has been entered. Either your attorney or the attorney for your former spouse should prepare and submit the Judgment with the terms as entered by the Court in 2012. Your attorney has a ethical duty to prepare the Judgment if the attorney was ordered to prepare it or if the attorney agreed to prepare it at the court hearing. Also you have a right to demand that the attorney sign a substitution of attorney if they will not prepare the Judgment. If not you can file a complaint with the California Bar.

If papers are not on file with the court you have no protection. I urge you to file something right away to stop him from cancelling your insurance coverage. Legal separation also requires paper work with the court. Do no hesitate get something on file with the court or you will have no protection.

In Michigan, there are several different factors a Court looks at in determining whether a party is entitled to "spousal support" (the technical term for "alimony" in Michigan). Three of the most important factors are: 1) the length of the marriage; and 2) the parties' respective incomes; and 3) the ability of the parties to work. Your lack of income may help you defend against a spousal support claim, but you should be prepared to explain to the Court why you aren't working (i.e., due to health problems, or lack of job opportunities despite looking for a job, etc.)
