What do I do if my husband drain our bank account before filing for divorce?

Answered by attorney Steven Jed Alpers (Unclaimed Profile)
Divorce lawyer at Steven J. Alpers, A Professional Corporation
It is too late to do anything about that now. You need to file for divorce and claim the money as part of the property to be divided. You may be able to use this as a reason to pay some of all of your attorney's fees.

Will an uncontested divorce on grounds of emotional cruelty have a negative effect on a person in law enforcement?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
If your case is in Arizona, this is a no-fault state, so the ONLY grounds for divorce is that the marriage is "irretrievably broken without prospect of reconciliation." Emotional cruelty is not an option. Arizona also has a minimum time frame of 60 days between when the divorce is served and when it can be made final.

Will my husband be entitled to my inheritance?

Laura J Gabel
Answered by attorney Laura J Gabel (Unclaimed Profile)
Divorce lawyer at Gabel, Gudmundsen & Gabel, P.C.
Generally, if you keep your inherited money in a separate fund in your name alone, don't commingle it with marital funds, and don't spend any marital monies on maintaining that fund, the Michigan courts treat such funds as separate, non-marital property in a divorce property division.
