How does infidelity affect the terms of a divorce?

California is a "No-fault" divorce state. There are no grounds other than irreconcilable differences that need to be proved. Infidelity does not change the divorce terms.

Can I withdraw my 401k without her signature if I have bifurcation status divorce?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
No that only deals with being single instead of married. It sounds like the property division has not yet been done. There are automatic temporary restraining orders in effect until each asset/debt is disposed of, so you would be in violation of the restraining orders.

Will my divorce be granted even if she doesn’t respond at all?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
the divorce will be granted but you need to take action with some paper work. If she has not filed a response you need to file a request to enter her default and some other forms. In order to get the judgment of divorce you need to have even more paper work prepared. I suggest you meet with a paralegal to help you with the documents so you can move forward to completion.
