If you are in China, and were married in China, the it would appear that the divorce court in China would have jurisdiction to, at the very least, dissolve your marriage. With respect to any claim you might have to the assets of your husband, that will depend on international law and treaty agreements between countries. I suggest that you speak with an attorney who is familiar with Chinese law on these matters.

Whether the court will award her the house is another matter. And, believe it or not, the fact that she left you for another man will probably not factor much in to the decision regarding who is awarded the house. Talk to a good divorce lawyer about your situation in detail. It's worth the effort and the expense.

There is no such thing as legal separation in the state of Texas. I strongly recommend you schedule a consultation with a family attorney in the State of Texas to determine whether or not your wife actually got a divorce or under what circumstances a judge ordered you to pay child support if you two are still married. If you're only separated (not legally divorced), then yes your wife would need to sign the paperwork for you to purchase a home, so it is imperative that you get divorced as soon as you can to make sure you are the only one legally benefiting from this transaction.
