No, an inheritance is separate property. If you use the money for the purchase of something else that both of you will use and enjoy (like a house), then it becomes quasi-community (or partially community) property.

If your husband's attorney will not help you finalize the divorce, your best bet is to hire an attorney of your own. Because your case is almost finalized, it shouldn't cost you a great deal to find someone to help you get it done. It could be that the attorney hasn't been paid by your ex, so he's withholding the final paperwork. Or there could be other issues at play with his attorney causing the delay (illness, travel, etc.). You just never know.

In all likelihood you are entitled to 50% from the date of the marriage, up until the date of separation, or the date of the entry of divorce. It would be best to have an attorney review the language in the Final Judgment and determine whether or not clarification is needed from the Court.
