Do I have legal grounds for a reduction in my child support payments?

default-avatar
Answered by attorney Patricia Christine Van Haren (Unclaimed Profile)
Divorce lawyer at Moradi Neufer
You have grounds for the termination of alimony based on your ex wife's cohabitation with another man. The courts have a presumption that cohabitation is a change of circumstance which is sufficient to modify or terminate the alimony. You should consult an attorney as you will need to thoroughly brief the cohabitation issue to the court. Alimony terminates when a spouse is remarried. Now that more couples are living together rather than living together, many courts view cohabitation as tantamount to a remarriage. Child support will not be modified as is based solely on timeshare of the parents and their respective incomes.

Go to the courthouse where you filed for divorce and get a copy of your case file. You need to make sure there was a Notice of Entry of Judgment filed. If that form wasn't done, it needs to be done and you will need to file for a hearing to request the court enter the judgement nunc pro tunc.

Going through divorce and receiving alimony, due to abuse and health can I keep the insurance?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
If his insurance is through his employer, you will not be able to continue to be insured by the employer. You will be given the option to pay COBRA to keep the insurance in force. You should check to see what that cost is and see if you can get your husband to pay it.
