Generally, in America, marriage is a legal status. A person cannot remarry if they are only legally separated. No remarriage is legally valid unless the party was unmarried at the time, read that divorced. "House marriages" where the party officiating does not require a marriage license, register the marriage with the authorities, and performed knowing that one of the persons is separated but not legally divorced are both invalid and potentially illegal. A person who knowingly marries another while they are married to a different person is a bigamist, which is a crime.

In most cases, the easiest and fastest way to resolve a divorce is to split all marital assets and debts equally. However, it will be up to both parties and their attorneys to hopefully work out an amicable solution so that a long and drawn out divorce case can be avoided.

If a house was purchased prior to the marriage, that house will not be classified as marital property. However, if a house is purchased during the marriage, the home will be considered marital property, so long as it is titled in the name of one of the parties to the marriage.
