Am I obliged to return the engagement ring if we are a having divorce due to his anger issues and aggression?

default-avatar
Answered by attorney James Timothy Weiner (Unclaimed Profile)
Divorce lawyer at James T. Weiner, P.C.
No An engagement ring is a gift given in contemplation of marriage. If you got married, even for a hour, you get to keep the ring because it is a completed gift and all contingencies (i.e. marriage) were fulfilled. If you break up while engaged you must give back the ring no matter what the reason for the breakup.

Is he entitled to reimbursement of the 21 months of payments she received after becoming remarried?

Answered by attorney Diane L. Berger (Unclaimed Profile)
Divorce lawyer at Diane L. Berger
they should stop upon her marriage. you will need to provide proof to the Court of the remarriage, i.e., a marriage certificate, etc., and then file a motion in the court for reimbursement in the amount of the alimony overpayment. Should be a simple matter.

How do I get a divorce when my husband's in the military?

default-avatar
Answered by attorney Willie Stephen Graves (Unclaimed Profile)
Divorce lawyer at Graves Law Firm
You're entitled to support while you're married to the military member, and the military services expect him to provide it. His command will require him to if you complain to his commander. He draws extra pay because he's married to you and/or has dependents. But your right to support from him will be over the day a divorce decree is signed; you haven't been married to him long enough to qualify for alimony. You should also be doing whatever is necessary to get child support from the children's father. The Texas Attorney General' s Child Support Division will help, and it costs you nothing. Good luck.
